Bill 65, the Builders’ Lien Act replaces the existing Mechanics Lien Act. Bill 65’s purpose is to modernize the NWT’s old liens legislation, which was last changed substantially in 1988. Since then, real property development, contractual arrangements and practices in construction have changed considerably and continue to evolve. Multiple Canadian jurisdictions have also updated their Builders’ Lien Act in recent years, including Ontario, British Columbia, and Alberta.
